Terms and Conditions of Rental

  • Month to Month Rental and Renewal Process: For your connivence, we do offer a month to month leasing opportunity. You will receive an invoice 7 days prior to the end of the month, at which point you will pay or vacate the storage unit.

  • Annual Lease and Renewal Process: Upon purchasing an annual lease, you will receive one month free. In order to take advantage of this perk, payment is due up front. With a month left on your lease, you will receive an invoice with the opportunity to renew your lease.

  • Rate and Payment: Storage unit payments will be deducted monthly from the time the rental agreement started. Automatic payments will continue for 12 months, at which point the tenant will resign their lease if they wish to extend. Accepted payments methods are all major credit / debit cards. In the instance where a payment doesn’t process, the tenant will be subject to a 5% per day late fee for that storage unit. If a full payment isn’t processed within 30 days of due date, the tenant will be subject to eviction.

Access and Security

  • Access Hours: 24/7 storage access

  • Security Measures: Please be advised that these are new construction. We are in the process of getting security measure in place- expected to be finished by January 1, 2025. Upon completion, storage units will be secured with the use of surveillance cameras, gated entry, and keypad access. Individual storage units will use a padlock, of which the leaser will be required to provide.

  • Keypad Access: Tenants will be provided with a code to enter the storage unit. Upon a need for eviction, the landlord reserves the right to change the access code after notifying the tenant and following standard eviction protocol- see below.

Usage Restrictions

  • Prohibited Items Include:

    • Hazardous and Flammable Materials

      • Examples: Gasoline, propane, oil, kerosene, fireworks, explosives, compressed gas, and chemicals.

      • Reason: These items can be highly flammable, toxic, or pose a risk of explosion.

    • Perishable Goods

      • Examples: Food (meat, fruits, vegetables), pet food, and any item that can spoil.

      • Reason: Perishable items can attract pests, rot, or produce strong odors, potentially damaging nearby items.

    • Illegal Substances and Items

      • Examples: Drugs, stolen property, illegal firearms, counterfeit goods.

      • Reason: Storage facilities must comply with the law, and illegal items pose a legal risk.

    • Living Things

      • Examples: Plants, pets, and animals.

      • Reason: Storage units lack light, ventilation, and temperature control needed for living things, which could result in harm or death.

    • Firearms and Ammunition

      • Examples: Guns, bullets, and other weaponry.

      • Reason: Firearms and ammunition are restricted due to safety and liability concerns.

    • Combustible or Toxic Materials

      • Examples: Paints, solvents, asbestos, pesticides, cleaning supplies, and other chemicals that are potentially toxic or corrosive.

      • Reason: These items can release harmful fumes or cause fires.

  • We recommend you don’t store the following items on your storage unit.

    • Valuable or Irreplaceable Items

      • Examples: Cash, jewelry, irreplaceable heirlooms, important documents, and sensitive electronics.

      • Reason: While not banned, we discouraged to store high-value or sentimental items due to the risk of theft or damage.

    • Medical or Pharmaceutical Supplies

      • Examples: Prescription drugs, medical equipment with sensitive materials, or oxygen tanks.

      • Reason: Medications may be sensitive to temperature and humidity, and oxygen tanks pose an explosion risk.

    • Construction or Demolition Debris

      • Examples: Concrete, asphalt, lumber, and other heavy building materials.

      • Reason: These materials are often too heavy for storage units and can damage the structure.

    • Wet or Damp Items

      • Examples: Any items that contain moisture, such as wet clothing, freshly cut grass, or wet furniture.

      • Reason: Moisture can promote mold and mildew growth, which can damage stored items and neighboring units.

    • Scented or Strong-Smelling Items

      • Examples: Strong-smelling candles, air fresheners, and perfumes.

      • Reason: Scents can attract pests and create issues for neighboring units.

  • Maintenance of Unit:

    • Tenants are required to keep their units clean. In the instance of minor pest control, such as mice, the tenant will be responsible for managing removal.

Insurance and Liability

  • Renter’s Insurance:

    • Tenants are required to have renters insurance and must submit proof within 30 days of leasing a storage shed.

  • General Liability Disclaimer

    • Negligence or Misconduct by Facility: If the facility fails to provide a reasonable standard of care (such as neglecting security measures or proper maintenance), it may be liable for damages. For example, if a known security risk was ignored, leading to theft, the facility might bear some responsibility.

    • Natural Disasters or "Acts of God": Events like earthquakes, floods, hurricanes, or tornadoes are usually considered beyond the facility’s control, and facilities generally aren’t liable for damages resulting from such events. Tenants are encouraged to seek insurance coverage for natural disasters.

    • Structural Damage: If the facility’s structure is compromised due to poor maintenance (e.g., a roof collapse, or structural failure that causes damage to stored items), the facility might be held liable. Proper documentation is essential for both tenant and facility records.

    • Liability for Specific Items: Musky Country Self Storage are not liable for items of high value or irreplaceable items (such as cash, jewelry, heirlooms, and essential documents).

    • Pest Control: Musky Country Self Storage take reasonable pest control measures, but we are not liable for damage from pests (e.g., rodents or insects) unless there is clear evidence of negligence in facility maintenance.

    • Liability Waiver: Tenants must sign a liability contract releasing the property owner of all liability the tenant may experience on the property. This includes but is not limited to theft, fire, water damage, natural disaster, vandalism or any other causes beyond the control of the landlord. This liability waiver also covers on premise injury, waiving the landlords liability of injuries that occur on the property.

    • Liability in Case of Lien Enforcement: If a tenant defaults on payments, storage facilities have the legal right to place a lien on stored property, potentially selling it at auction. If the tenant is 30 days late on rent, they will be evicted. They have 30 days to evacuate the storage unit, or their storage unit will be confiscated and proper legal actions will be taken, including the risk of selling belongings at auction.

Termination and Default

  • Default in Payment: If the Tenant fails to pay the rental fee within 10 days of the due date, the Landlord will provide written notice of non-payment. The Tenant must remedy the payment within 5 days of receiving the notice. If payment is not received within this time, the Landlord may initiate eviction proceedings. There will be 5% late fee added per day payment is overdue.

  • Violation of Terms: The Tenant agrees to abide by all terms of this Agreement. If the Tenant breaches any term, the Landlord will provide written notice specifying the breach. The Tenant will have 10 days to correct the violation. If the Tenant fails to correct the violation within the specified time, the Landlord may initiate eviction proceedings.

  • Unauthorized Use: The Tenant shall use the storage shed solely for storage purposes. Any unauthorized activities will be grounds for immediate eviction without notice.

  • Termination of Agreement: In the instance where an agreement is terminated, the Tenant must vacate the premises by the termination date. The Landlord will provide 30 days’ written notice prior to termination.

  • Abandonment: If the Tenant leaves the storage shed unattended for 30 consecutive days without notifying the Landlord, the Landlord may consider the shed abandoned and may proceed with eviction and disposal of the contents.

Dispute Resolution

  • Initial Negotiation: In the event of a dispute arising out of or relating to this Agreement, both parties agree to first attempt to resolve the dispute through informal negotiation. Each party will appoint a representative who has authority to resolve the dispute and will engage in good faith discussions to reach a resolution.

  • Mediation: If the parties are unable to resolve the dispute through negotiation within 30 days, they agree to submit the dispute to mediation. The mediation will be conducted by a mutually agreed-upon mediator or, if the parties cannot agree, by a mediator from the [designated mediation organization, e.g., American Arbitration Association]. Each party will bear its own costs in connection with the mediation, and the parties will equally share the mediator's fees.

  • Arbitration: If the dispute is not resolved through mediation within 60 days of the mediation request, either party may submit the dispute to binding arbitration. The arbitration will be conducted in accordance with the rules of the [American Arbitration Association] in effect at the time the arbitration is initiated. The arbitration shall take place in Hayward, WI. The arbitrator's decision shall be final and binding on both parties.

  • Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any legal action arising from this Agreement shall be initiated in the courts of Sawyer, Wisconsin.

  • Attorneys’ Fees: In the event of any dispute, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs incurred in connection with the resolution of the dispute, including any arbitration or litigation.

  • Limitation of Liability: Neither party shall be liable for any consequential, incidental, or punitive damages arising from this Agreement, except in cases of gross negligence or willful misconduct.
